These Terms & Conditions govern your use of the Offbeat website and your purchase of Offbeat products. By accessing our website, placing an order, or purchasing a product from Offbeat, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

In these Terms & Conditions, “Offbeat,” “we,” “us,” and “our” refer to Offbeatbymusz, and “Customer,” “you,” and “your” refer to any person who visits the Offbeat website, places an order, or purchases an Offbeat product.

1. About Offbeat

Offbeat creates distinctive, handcrafted furniture and design pieces, including tables, consoles, side tables, wall pieces, and other specially designed products.

Many Offbeat products are handcrafted and made-to-order. As a result, certain natural variations and handmade characteristics may occur from one piece to another.

2. Orders & Payment

Orders placed directly through the Offbeat website require full payment of the order amount at the time of purchase.

Customers who wish to pay a partial amount in advance and the remaining balance upon delivery may do so only where this arrangement has been specifically agreed with Offbeat in advance.

Such arrangements may be made:

• During a visit to the Offbeat showroom; or
• Through direct communication with Offbeat by phone or other official communication channels.

Accepted payment methods are Visa, Mastercard, and Apple Pay.

An order is considered confirmed once the agreed payment has been received.

Production may begin only after the required payment and order confirmation have been completed.

Where a partial payment arrangement has been agreed, the remaining balance must be paid in full upon delivery, before or at the time the product is handed over. Offbeat may withhold delivery until the remaining balance has been paid.

Ownership of a product passes to the customer only once the full order amount has been paid.

Offbeat reserves the right to decline or cancel an order before it is confirmed, including where a product is unavailable or a pricing or listing error has occurred. In such cases, any amount paid will be refunded in full.

Whether an advance payment is refundable if an order is cancelled is governed by Offbeat's Refund & Cancellation Policy.

3. Prices

Prices displayed on the Offbeat website are subject to change without prior notice.

All prices are stated in Egyptian Pounds (EGP) and include value-added tax (VAT), unless otherwise stated.

The price applicable to an order is the price confirmed at the time the order is placed and paid for, subject to any agreed terms.

Additional charges, where applicable, including delivery, installation, special handling, or other services, will be communicated to the customer before the order is confirmed.

If a product is displayed at an obviously incorrect price due to a technical or typographical error, Offbeat is not obliged to supply the product at that price. Offbeat will contact the customer to confirm the correct price or to cancel the order with a full refund.

4. Customization

Offbeat offers customers the possibility of customizing products, where applicable.

Customization may include, but is not limited to:

• Dimensions
• Materials
• Colors
• Finishes
• Design details
• Other agreed specifications

Customers are responsible for reviewing and approving their requested specifications before production begins. Approval must be given in writing, such as by signing the quotation or confirming the specifications by email, WhatsApp, or another official Offbeat communication channel.

Changes After Order Confirmation

Customization changes may be possible only depending on the stage of production.

For example, changes relating to dimensions, wood components, or other structural elements may no longer be possible once the relevant production stage has begun.

Changes to paint or finishing may still be possible if production has not yet reached the relevant finishing stage.

Offbeat reserves the right to refuse any requested modification where the production stage, materials, or work already completed makes the modification impractical or impossible.

Any additional costs or changes to the estimated delivery date resulting from an approved modification will be communicated to the customer before the modification is implemented.

Because customized products are made specifically to the customer's specifications, cancellations and refunds for customized orders are subject to the conditions set out in Offbeat's Refund & Cancellation Policy.

5. Production & Delivery

The standard estimated delivery period for confirmed orders is approximately 60 days from the date of order confirmation, unless another timeframe has been specifically agreed with the customer.

Production and delivery times may vary depending on the product, customization, materials, production requirements, and other circumstances.

Where the customer requests a different delivery date, Offbeat may accommodate the request subject to production and delivery arrangements. Delivery dates may be adjusted by mutual agreement between Offbeat and the customer.

Delivery Areas & Fees

Offbeat delivers to Cairo, Giza, and Alexandria. Delivery fees, where applicable, depend on the delivery location and the size of the product and will be communicated to the customer before the order is confirmed.

Access to the Delivery Location

The customer is responsible for ensuring that the product can be safely delivered to and placed in its intended location, including by confirming the dimensions of doorways, staircases, hallways, and elevators before ordering. Offbeat is not responsible where a product cannot be delivered or installed due to access restrictions at the delivery location, and any resulting additional handling, return, or redelivery costs will be borne by the customer.

Failed Delivery & Storage

If delivery cannot be completed because the customer is unavailable, has provided an incorrect address, or is not ready to receive the product on the agreed date, Offbeat may charge a redelivery fee. Where the customer does not accept delivery within seven (7) days of being notified that the product is ready, Offbeat may charge reasonable storage fees.

Risk of Loss or Damage

Responsibility for loss of or damage to the product passes to the customer once the product has been delivered to the agreed delivery address.

6. Delivery Inspection

Customers should inspect their products immediately upon delivery.

Any visible damage should be noted on the delivery documentation before signing.

Hidden damage or manufacturing defects should be reported within the period specified in Offbeat's Refund & Cancellation Policy.

Where reasonably possible, customers should retain the original packaging until the applicable inspection or claim period has ended.

7. Product Information & Handmade Variations

Offbeat makes reasonable efforts to ensure that all product descriptions, dimensions, photographs, materials, finishes, and other information displayed on the website are accurate.

However, differences may occur between photographs displayed on the website and the actual product due to:

• Natural wood characteristics
• Lighting and photography
• Screen and display settings
• Handmade production
• Natural variations in color, grain, and texture

Such variations are considered part of the character of handcrafted products and natural materials and do not automatically constitute defects.

Dimensions stated on the website or in a quotation are approximate and may vary within a tolerance of up to 5 cm due to the handmade nature of the products.

Solid wood is a natural material that may expand, contract, or show minor movement in response to changes in temperature and humidity. Such movement is a natural characteristic and does not constitute a defect.

8. Warranty & Care

Offbeat warrants its products against structural and manufacturing defects for a period of one (1) year from the date of delivery, under normal domestic use and in accordance with Offbeat's care instructions.

This warranty does not cover:

• Normal wear and tear;
• Damage caused by misuse, accidents, or improper handling;
• Damage caused by direct sunlight, heat sources, water, moisture, or humidity;
• Natural variations and characteristics described in Section 7 (Product Information & Handmade Variations);
• Products that have been modified or repaired by anyone other than Offbeat; or
• Damage resulting from failure to follow Offbeat's care instructions.

Where a covered defect is confirmed, Offbeat will, at its discretion, repair or replace the affected product or part. Warranty claims may be submitted through the official contact details published on the Offbeat website.

This warranty is in addition to, and does not limit, any rights granted to consumers under applicable Egyptian law.

Care Instructions

To preserve the quality of Offbeat products, customers should keep them away from direct sunlight, heat sources, and excessive moisture, clean them with a soft dry or slightly damp cloth, and avoid harsh chemicals. Any specific care instructions provided by Offbeat for a product should be followed.

9. Refunds, Cancellations & Returns

All matters relating to cancellations, refunds, returns, damaged products, defective products, and applicable cancellation periods are governed by Offbeat's Refund & Cancellation Policy.

The Refund & Cancellation Policy forms an integral part of these Terms & Conditions.

By placing an order, the customer acknowledges and agrees to both documents.

10. Customer Responsibilities

Customers are responsible for providing accurate and up-to-date information, including:

• Name
• Contact information
• Delivery address
• Order specifications
• Customization requirements
• Any other information required to complete the order

Offbeat shall not be responsible for delays or additional costs resulting from inaccurate or incomplete information provided by the customer.

11. Intellectual Property & Design Rights

All original designs, concepts, product forms, artistic elements, drawings, sketches, technical drawings, dimensions, models, renders, photographs, videos, graphics, product descriptions, names, branding elements, and other creative materials developed, created, published, or displayed by Offbeat are owned by Offbeat or used by Offbeat under the applicable rights.

Unauthorized Use Is Strictly Prohibited

Offbeat strictly prohibits the unauthorized copying, reproduction, imitation, modification, manufacture, distribution, sale, or commercial exploitation of its designs.

Without Offbeat's prior written authorization, no person or entity may:

• Copy or reproduce an Offbeat design.
• Recreate an Offbeat product or a substantially similar design.
• Manufacture an Offbeat design, or have it manufactured, through another workshop, carpenter, factory, manufacturer, or third party.
• Provide Offbeat designs, drawings, dimensions, specifications, photographs, or technical information to another party for reproduction.
• Create CNC files, 3D models, manufacturing files, or other production files based on an Offbeat design.
• Reverse-engineer an Offbeat product for the purpose of reproducing or commercially exploiting its design.
• Modify an Offbeat design for the purpose of creating a substantially similar product.
• Sell or commercially exploit a product based on an Offbeat design.
• Represent an Offbeat design as their own work.
• Use an Offbeat design as the basis for a competing product.

These restrictions apply regardless of whether the resulting product is identical, modified, resized, produced using different materials, or altered in appearance, where the resulting product substantially reproduces or derives from an Offbeat design.

Drawings, Dimensions & Technical Information

Any technical drawings, sketches, dimensions, CNC files, 3D models, renders, specifications, manufacturing information, or other technical materials provided by Offbeat remain the property of Offbeat unless expressly agreed otherwise in writing. Such materials may not be copied, reproduced, distributed, published, shared with third parties, used for manufacturing, or used to create derivative designs without Offbeat's prior written authorization.

Ownership of Purchased Products

Purchasing an Offbeat product gives the customer ownership of the physical product purchased only.

It does not transfer ownership of the underlying design, intellectual property, drawings, concepts, technical information, or other creative rights belonging to Offbeat.

Nothing in this section prevents a customer from using, displaying, or reselling a genuine Offbeat product that they have lawfully purchased.

12. Website, Showroom & Content Use

The Offbeat website may only be used for lawful purposes.

Website Images, Photography & Content

All photographs, videos, graphics, product images, written content, website materials, and visual assets published through Offbeat's website or official communication channels are protected by applicable intellectual property rights.

No person or business may download, reproduce, republish, edit, modify, redistribute, or commercially use Offbeat's photographs, videos, graphics, written content, or other visual content without prior written permission from Offbeat. This includes using Offbeat content:

• On another business's website
• On social media
• In advertisements
• In catalogs
• In marketing materials
• In online marketplaces
• To promote products manufactured by another party

Photography at the Offbeat Showroom

Photographs or videos taken inside the Offbeat showroom or at Offbeat exhibitions may include Offbeat products, displays, designs, artwork, or other proprietary materials.

Offbeat does not grant permission for such images to be used for commercial purposes without prior written authorization.

Customers and visitors may not use photographs taken at the showroom to reproduce, market, advertise, manufacture, or commercially exploit Offbeat designs or products.

Website Use

Users may not:

• Systematically collect or scrape Offbeat product information.
• Attempt to gain unauthorized access to the website.
• Interfere with the operation or security of the website.
• Use the website or its content in violation of applicable laws or third-party rights.

13. Enforcement of Rights

Where an Offbeat design or content is protected by applicable intellectual property laws, including Egyptian Law No. 82 of 2002 on the Protection of Intellectual Property Rights, unauthorized reproduction, manufacture, distribution, sale, or commercial use may constitute infringement of Offbeat's rights.

Offbeat reserves the right to take appropriate legal action against any person or entity that unlawfully copies, reproduces, manufactures, distributes, sells, or commercially exploits its protected designs or content.

Such action may include seeking any remedies available under applicable Egyptian law before the competent courts and authorities, including the competent Economic Courts where applicable.

Nothing in these Terms & Conditions limits any rights or remedies available to Offbeat under applicable law.

14. Customer Data & Privacy

When customers place an order, contact Offbeat, request a quotation, customize a product, or otherwise interact with Offbeat, Offbeat may collect and retain information necessary to provide its services. This information may include, where applicable:

• Customer name
• Telephone number
• Email address
• Delivery address
• Billing and order information
• Product specifications and customization requests
• Communication and correspondence relating to the order
• Information necessary for delivery, installation, payment, customer support, and after-sales service

Offbeat may use this information for legitimate business and operational purposes, including:

• Processing and fulfilling customer orders.
• Arranging delivery and installation.
• Communicating with customers regarding their orders or inquiries.
• Providing customer support and after-sales service.
• Maintaining transaction and customer records.
• Contacting customers regarding relevant product updates, new collections, new releases, exhibitions, or other Offbeat announcements, where permitted by applicable law and subject to any required consent or opt-out rights.

Offbeat may retain customer information for as long as reasonably necessary to fulfill orders, provide customer service, maintain business and transaction records, comply with applicable legal or regulatory obligations, and protect its legitimate rights and interests.

Offbeat will take reasonable measures to protect customer information and will handle personal data in accordance with its Privacy Policy and applicable Egyptian laws and regulations, including Personal Data Protection Law No. 151 of 2020.

Offbeat will not sell or commercially trade customers' personal information to third parties.

Where third-party service providers are required to fulfill an order or provide a service, such as delivery, payment, hosting, or other operational services, Offbeat may share only the information reasonably necessary for that specific purpose, subject to applicable law.

Customers may contact Offbeat regarding their personal information or their communication preferences through the official contact details published on the Offbeat website.

15. Third-Party Services

The Offbeat website may use third-party services, including payment providers, delivery providers, hosting services, analytics services, or other external platforms.

Offbeat is not responsible for the independent policies, availability, or practices of third-party services outside Offbeat's reasonable control.

16. Force Majeure

Offbeat shall not be responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including but not limited to natural disasters, fires, transportation disruptions, strikes, governmental actions, supply shortages, material shortages, technical failures, or other extraordinary circumstances.

Offbeat will notify the customer as soon as reasonably possible of any such delay. If the delay continues for more than sixty (60) days beyond the estimated delivery date, either the customer or Offbeat may cancel the affected order, and amounts paid for the undelivered order will be refunded in accordance with Offbeat's Refund & Cancellation Policy.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Offbeat's total liability arising from or in connection with any order or product shall not exceed the amount paid by the customer for the relevant product.

Offbeat shall not be liable for any indirect, incidental, or consequential loss, including loss of profit, loss of business, or loss of opportunity.

Nothing in these Terms & Conditions excludes or limits any liability that cannot be excluded or limited under applicable law, or any mandatory rights granted to consumers under Egyptian law.

18. Changes to These Terms

Offbeat reserves the right to modify or update these Terms & Conditions from time to time. The updated version will be published on the Offbeat website with a revised “Last Updated” date.

The version published on the website at the time an order is confirmed applies to that order, subject to applicable law.

19. Governing Law

These Terms & Conditions shall be governed by the applicable laws of the Arab Republic of Egypt.

Any dispute shall be subject to the jurisdiction of the competent courts and authorities in New Cairo, Egypt, subject to any mandatory rights granted to consumers under applicable law.

20. General Provisions

Severability: If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Order of Precedence: Where a written quotation or agreement confirmed by both Offbeat and the customer contains specific terms for an order, those specific terms prevail over these Terms & Conditions to the extent of any conflict.

Entire Agreement: These Terms & Conditions, together with the Refund & Cancellation Policy, the Privacy Policy, and any order-specific written terms, form the entire agreement between Offbeat and the customer regarding an order.

Language: These Terms & Conditions are available in English.
